Rear ended / Lower Back still hurts

It has been a week since I was rear ended. Initially I did not feel any pain but after an hour my lower back started hurting. I went into my doctor and he thought I may have just sprained it. I received a call from the other persons insurance company and told them I went to a doctor and he thought I sprained my back(should clear up in a few days). They offered me $150.00 for pain and suffering. It has now been a week and no improvement in my back. I am going to call the doctor and ask for a referal to a specialist. What is th ebest approach to take with the insurance company. I just want to make sure my back is going to be ok and that they cover the expenses. But I do not trust them.

Do not take any type of settlement yet! once you take a settlement you no longer have the ability to get reembursed from the at-fault insurance. get checked out by a specialist and go from there with your injuries. If it was a minor accident you should feel fine with a little therapy be it physical therapy, massage therapy ect. Good Luck!

back pain settlement

I was rear ended in the state of Delaware. My 2 sons and myself were all checked out at the ER. Son #1 was fine. Son #2 hit his head and had a headache, but is now fine. I braced for the impact and sustained lumbar muscular strain and am taking valium and ibuprofen for it. I was out of work for 2 days but plan on returning on Monday.

The insurance company called and told me that we would be due a "nuisance fee" and that if I wanted to hire an attorney that I could do so. My sons are fine, and I asume that my back will get better day by day. The insurance agent said that he will call me next week to discuss how much the "nuisance fee" will be for the 3 of us. I have no clue what to ask for. What is typical in an instance such as this?

I will be seeing my family doctor next week to be sure that there is no long term damage to my back. I've never hired an attorney before, and hope that I don't have to. Please advise.

Usually they will offer you an amount for a settlement in exchange for you not pursuing the issue further. In your case the amount will probably be a small amount. I would wait to decide anything until after seeing your doctor and getting a feel of what injuries you may have. If you have injuries, you may need more money from the insurance company to cover your medical bills and what they are offering to settle for now may not be enough.
