Rear ended by an uninsured motorist


I was rear ended by an uninsured motorist just before Hurricane Charlie. I was hospitalized and released later that evening with strict orders to not lift or do anything physical until I visited a specialist on my back. Well I could not protect my house on Hurricane Charlie's arrival. Then Hurricane Charlie hit and we were with out anything for a month. Once everything started coming back online here I was able to see a chiropractor and a neurologist. Had my first MRI that showed two buldging disk at the time. About a year later of therepy I was ordered for a second MRI. This time shows Degenerative Changes, disk buldging, dehydration all in the L3-L4, L4-L5, L5-S1. After all this I am then being sent over to an Orthopedic Specialist for further observation. I am still waiting to see that doctor.

Out of all of this my Attorney is dealing with my insurance company for me. They are coming back with a very low settlement. In understanding that it could not be known what my future medical needs are, I am concerned what my choices are and or should be. My attorney is also pretty gung-ho about taking this to suit, but is not sure of the determining factor of what I should be compinsated for. To me it seems like my own insurance company is screwing me or I just don't have all the legal information I should have.

I just want to know that I will not have to pay out of pocket in my future like I have been during this whole fiasco. I want to be reimbursed for what I have had to pay out of pocket plus future medical, and my attorney's fees. What my insurance company has offered does not even come close to my property damage, rentals, time out of work, , pain and suffering, and future medical.

Is this to much to ask for???

How long did you wait after the accident before you started treating with a chiropractor?

Have any of the doctors you have seen told you that your bulges and dehydrated discs were caused by the accident or just degenerative changes? how old are you?

i also have some questions to help me understand ur situation, rameis. questions like;

1. what was the amount of damages to ur and the um vehicle?
2. what are ur total medical bills and lost wages and what r the limits of ur
umbi coverage? what was the offer the insurance company made?
3. for what reason did u see the neuro and who referred u to him/her?
4. what were the sizes of these bulges and were they impinging on any of
the nerve roots?
5. why did u need therapy for one year? was there an alternate course of
treatment suggested for ur complaints, such as epidural blocks
(injections)? if one year of therapy did not help resolve ur injury, one
would question the necessity of such treatment that offers no curative
benefit and appears palliative in nature. dehydration or desiccation of
discs is for the most part attributable to disc degeneration and not
necessarily trauma induced.
6. why is ur atty not sure of the determining factor of what u should be
compensated for? does he suspect ur injuries not being accident related
or that he has built up the medical bills to effectuate a good settlement?

Well I could not seek immediate chiropractic care after the Hurricane. I had to wait for about 6 weeks for something to open. The surrounding counties were flooded and would have taken about 6-8 weeks. The damages to my vehicle were about 2500.00, and the other vehicle was about totaled. My medicale bills up to date paid is about 12,000.00. What the insurance company is offering is 7500.00, but my UM is covered up to 100,000.00. I can not get all the answers out of the doctors, but the information that I do get is the mild disk buldging and progressive disk dehydration. My chiropractor refered me over to the neurologist, but the neuro has not refered me to anyone else until I asked him to refer me to an orthopedic for additional evaluation and information. I talked with an other attorney and seem to get different answers. Both the chiropractor and the neurologist tell me that this is a cause of the accident even at the age of 29 as well as both attorneys. The way I see things I don't think the proper information is getting to the Attorney. I think that somewhere I am not being told everything. I have constant pains that I have never had before, I explain it to the doctors and I seem to get no answers. I can't even lift my own son who is only 4. As far as how much the buldging is I can't even get that answer from the doctors. I am getting frusterated
