What is the name of your state? Illinois

I was at a red light and was rearended by a car that was rearended by an uninsured driver. This happened about two years ago and now my insurance company is giving up on the claim so I am out the deductible. The problem is I feel that the guy who hit me should be responsible for my damage. He happens to be insured by MY COMPANY. They said no they can pay on it because he was pushed into me. I say good then his policy can try to get the money out of the uninsured guy and should pay my deductible because HE was the one who hit me.

Any info on this?
