Rearended in Florida in a new car

Hi,

I had just bought a brand new car (in Florida) two weeks ago (it has less than 500 miles on it) and was rear-ended by another driver. There was damage to my rear-bumper, taillights and frame-beam. Is there a way to get the whole car replaced instead of just fixing the damage since my car was so new?

My response:

Not unless there is an irrepairable safety issue involved. If the insurance company can successfully have the vehicle repaired to manufacturer specifications, including safety items; e.g., the frame, then you have no further claim to obtaining another vehicle.
