Recorded statement of other party

I was rear ended by a Uhaul truck driven by a Uhaul dealer transfering the truck to his lot. When he hit me the first thing he said was "I hit the brakes but they didn't work". I have requested from his//Uhaul's insurance company a copy of his recorded statement, they say they cannot/will not provide that to me. Are they required to if asked? How can I force them to provide this?
I reside in and the incident occured in Indiana.
