Release of Claim


What is the name of your state? Indiana
LAst summer my daughter was a passenger in a car that was in an accident. She was ok but hit her head pretty good and she went ahead and went to the emergency room and had an MRI and was cheched out. She was pretty well out of it for a weekend but 6 months later there are no signs of any problems. The reponsilbe parties insurance has paid her $2700 in hospital bills and now wants to close out the claim. They sent her a "release of claim" form and a promise to send her $300 if she signs and returns it. I am feeling unsure about doing this. Any advice would be greatly appreciated. Thank you.

Why? If there is no damage, and the amount is acceptable, what's the problem.

If you beleive there may be additional problems, you had better work fast since your time to file a suit is winding down fast.

Sorry about that. I re-read your post and saw you meant this past summer. I read it initially as '05.

You can wait awhile then if you neleive thre may be problems but if there is, a doctor should be consulted. A docvtoor may also be able to belay any fears you have and assure you there is little chance of damage showing up at a later date.

If it has been six months & there have been no problems/no permanent damage, your daughter probably is ok in signing & returning the release form.** However, as justalayman indicated, your daughter can wait a while to sign in case any problems did show up & then, of course, consult a dr. promptly. Is she currently seeing a dr. on a regular basis due to the accident - if so, what does the dr. think about any futher possible problems? **but a dr. can give you a better idea re this than me
