Rental agreement and unauthorized driver

What is the name of your state? New Jersey

We are in a difficult situation. My friends and I planned a trip to Canada for our vacation. We rented a car from Newark ariport and traveled to Toronto. No additional driver was listed in the rental agreement. While in Toronto, the original renter had to fly back to New Jersey to handle an urgent matter at work. We found ourselves in an unexpected situation. We need to return to he US. To complicate the matter, we are all younger than 25 (but older than 18). We called rental company and they told us none of us can drive the car or could be added as an authorized driver in the rental agreement because we are younger than 25. Moreover, even if one could be added, the original renter must be physically present to do so (but the original renter is not here!). Since we will return to US at Niagra border, the rental company told us that if immigration officials find out that the driver is not listed in the rental agreement, they would consider it an immigration violation. Next ,they would call the police who would arrest the driver and impound the car.

What are our options? What is the law regarding a driver not listed in rental agreement? In our case, would New York's law apply or New Jersey's? Assuming that we not involved in any accident, what's the worst that could happen?

Please help!
