Rental Car Accident: Need Advice


New York

Hi, I was involved in an accident today and I need some quick advice. To make a long story short, I was involved in a minor car accident (broken rear view mirror and scratches on one side of car) with my rental car. It was not insured for loss and damage from the rental place. I already filed a police accident report for both vehicles/parties involved in the accident. I do not have my own insurance as I dont own a car, nor did I use my credit card to pay for the rental car.

Assuming it is not my fault, how should I go about claiming the damage to the rental from the other party involved? Do I call up the other party and tell him I will take it up with his insurance company and go from there? How does the claiming process work now that I do not have any insurance company to help me collect the damage?

Then how EXACTLY did you rent that car?? I don't know of any rental car agency that will let you drive away without insurance or at least a credit card on file.

You don't. Contact the rental car agency and let them pursue the at fault driver.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I will go to the rental car agency tomorrow personally. But even if I did not purchase Loss & Damage insurance from the rental place, would they still help me collect the damage from the fault party? That is the part I was wondering myself.

Can't answer as to what someone else might do... but they could just hit YOU with the damage claim... and let you attempt to recover from the other party... rather than get into a pissin' contest as to which of you is at fault.
Or, they could be very nice and say, "No problem... we'll just go after the other guy!!".

If the other party was at fault, you can see if the rental car agcy. will go after the at fault driver by trying to get reimbursement from their ins. co. However, as JETX indicated, they may make you responsible for all damages to the rental car. You will then have to submit a claim to the other party's ins. co. for reimbursement. I don't see how they let you rent a car without taking their rental ins. coverage since you did not have ins.
edited to add: Many rental car contracts make the renter liable for all damage to the rental car regardless of fault. You may also be liable for loss of revenue the car rental agcy. suffers as a result of the car being unavailable to rent while being repaired.

JETX hit the nail on the head here as usual. You can be sure they're going to require you pay for the damages and you'll have to pursue reimbursement from the other party. If they're at fault and won't pay for the damages, you'll have to sue them in small claims court.
