Rights to Copies of Recorded Conversations


What is the name of your state (only U.S. law)? California

I filed a claim with an auto insurance company in California (I was involved in an accident with one of their insured). This insurance company recorded conversations between me and them. Do I have the right to copies of these conversations? If so, how would I proceed to obtain them?What is the name of your state (only U.S. law)?

Not sure of the particular laws in your state. But yes, you are entitled to a copy of YOUR recorded statement. Contact and request a copy from the adjuster who took the statement from you. In some cases it may be necessary for you to send your request in writing.

Outside of court, you have no legal claims to the property of another. Those recordings are the property of the insurance company and the only possibility you have to compel them to provide them is IF you are in the midst of litigation, the courts may be be convinced they are crucial to your situation. Depending on whose insurance company this is and exactly what is happening now, the courts may not even be able to compel the insurance company to provide a copy to you.

If you are in litigation, you can request the recordings under the rules of discovery but other than that, you have no rights.

They might give you a copy if you ask, but outside of a subpeona, they are not required to. As mentioned, they are company property, not yours.
