A few nights ago a police office woke me up to ask me to move my car which had just been hit by a drunk driver. It was a hit and run and I plan to review the police report. The neighbors witnessed it and called it in and so they did apprehend the driver. He has insurance. His auto insurance deems my car a total since the damages exceed the value they determined my older Honda Civic wagon to be. They aren't even offering blue book value which is low. I recently drove it across country. I feel it is a great car and just want to fix it. I have no collision on it and little money. Are there legal actions I can take to get the insurance company to either pay for repairs or "up" their settlement amount. It was not only an accident; it was a crime. The agent has already lied to me about the parameters by which he determines the value of my vehicle, but said he would look again.
