Scraped by car while exiting parking lot driveway


What is the name of your state? Texas.

This is a very weird situation which just happened earlier tonight. After dinner earlier tonight with my girlfriend (we drove separate cars and she was right behind me) we got our cars and then proceeded to leave the parking lot of the restaurant. The driveway in and out of the parking lot was very wide (it can fit four cars side by side) and I saw a BMW waiting on the driveway preparing to leave the parking lot. If you had four cars lined up side by side on the drive way, I would say she would be the third car from the left (there were no other cars at the time).

Thinking she wanted to turn left or go straight, I drove my car to the right of her, as I wanted to turn right onto the street. I guess she didn't see me as once traffic allowed, she proceeded to turn right without looking at my car at all. As a result, the side paneling on the right hand side of her car scrapped the left corner near my headlights - putting a huge dent there. The side paneling of her car suffered significant damage as well.

At the time, my car was still totally on the driveway of the parking lot, although on impact, her car was on the streets. Whose fault is this? Can anyone give me a hint?

In the meantime, she also called her lawyer boyfriend to come along and look at the damages. The guy tried to intimidate me into saying it was my fault - I told him "I don't know" and that I will let the insurance company decide. We exchanged information but when we were leaving, the guy told me to "better" admit it was my fault or that he would be "out to get me." I feel that this was totally unnecessary. Has anyone on this forum experienced something like this before?

It is our unanimous opinion that you are damn right and it should be obvious to any moron that your (ex) (SO’s ex) (boss) (landlord) (local police) should be immediately (jailed) (fired) (reprimanded) (arrested) (demoted) (shot) (evicted).
In fact, you are so astonishingly correct in this matter, it will not surprise us one bit if you are offered a generous settlement, because, by golly, that’s just how it should be.
