Gathering info for a friend:

Say theres an accident,the person @ fault for the accident is CLEARLY and admittedly @ fault....BUT the person who was hit,had lapsed auto insurance..

how would that affect the injured party? And the at fault party?

Something is telling me that the uninsured(my friend) had no right to be on the road...and will be penalized for that....not sure. Any advice appreciated.

Lack of insurance is a criminal matter while the damages resulting from the accident are a civil matter (though there can be criminal charges there too). So the lack of insurance on the part of the other party doesn't make a difference as far as your friend is concerned.
