Settlement Question or Advice


What is the name of your state? Indiana

I was rear ended about three months ago by a guy who was speeding, late for work, bad brakes, ect ect... I went to to the emergency room with a hurt shoulder and back, wound up in physical therapy for a couple of months. On work restrictions until the doctor released me a couple days ago. I already settled the property damage to my car - actually got more to repair it then it was valued in blue book after cursing the adjuster when he tried to total it (I had just done some major engine work, it is my work car). Now is time to settle my injury claim. I have around three grand in medical bills from therapy, ER and doctor visits. I am not asking what the value of the claim is, as I already read through alot here. I am asking for $10,000 that will include the medical bills plus a bit for me. I don't plan to budge. I figure that if I had a lawyer the adjuster would probably pay that anyway. That would leave me $7,000 for my personal damages. Will the adjuster tell me get lost or argue with me or cave when I hold strong? Let me know your opinions.

in my opinion, the adjuster should give you the $10,000 and settle your claim. i'm not attorney but i believe that people are generally compensated either 2 or 3x their medicals, pain/suffering, loss wages, etc. Your'e not asking for much more than the amount of your total loss. if you ask for that amount, you should get it or pretty close to it.

I agree with tylintylin that you should receive atleast what you stated, but I have also heard that you ask for more than what you're actually willing to accept that way you have room to
'' haggel '' . you tell them what you're expecting, they make you a counter offer and so on. and if you get no settelment offer you're satisfied with then you can still talk to a personal injury lawyer, most charge nothing to discusse your case and you could come out with more than you expected. One More Thing.


Something I forgot to mention was that you might want to see were you would stand with the expense of any future medical treatment and cost due to the injurys you sustained in this wreck, just something to think about if your injury's are one's that may cause you to seek more care in the future,.
