I was on a two lane road, waiting in the left turn lane. A tractor trailer coming out of a driveway to the right of me swung his truck out too far and hit the right rear of my car. No serious injury, but I saw the chiropractor about 7 or 8 times for x-rays and minor muscle soreness. The other insurance company wants to pay for car damages (about $1100, a check made out to me) and also the chiropractor (about $900). They are also offering to pay $1000 for pain & suffering. I was told to make an offer if I didn't think this amount was fair. I know the offer is probably on the low end of what they are allowed to pay. What would be an appropriate counter-offer to make and what should I "expect" to end up getting? Thanks for your time and your help!

| | | I really don't think it's a personal decision. I keep putting off responding to the man from the insurance company because, like I said, I don't know what's fair. I just don't know how much to counter-offer with. I am not going to come back and be upset with someone that they told me an amount too high/low. Perhaps someone could give me a range? |

| | | It IS a personal decision. $1000 over and above your actual damages sounds pretty fair to me. No permanent injuries, short treatment time, etc. Ask for more if you like, but that amount for pain and suffering alone when your bills were not even $1k, again sounds fair to me. |

| | | based on what you have said, i think that sounds completely fair, they offered you 30% of your actual damages in excess of paying all your damages. i would take it and run. |
