should i drop my lawyer?

What is the name of your state? texas
Lawyer is charging 33% of total settlement.
The other car in a 2 car accident was at fault - I have full coverage car insurance - I visited emergency room and dr said i was ok and would have whiplash for a few days. Other party's insurance is cooperating. I cannot talk to my insurance because lawyer has a "no talk" order in effect. Should
I terminate my lawyer? Accident occurred opn 10/24/06 and results have stalled.

You retained an attorney when you had just an ER visit and and no followup treatment? Yes, your attorney is entitled to whatever is in your written retainer agreement, and if you fire him his name will still be on the settlement check; you will have to negotiate his fee with him.
