I am in California
I was in a car accident about 7 weeks ago the the person who hit me admmited to trying to page his girlfriend with his cell phone and this caused him to loose control as well as having 2 beers and a shot of tequilla 2hours before the accident (he is under 21 had to surrender license at the scene) he was not sited for being under the influence this is all on the accident report
I made the mistake by not going to the doctor right away appointment is tuesday lower back is still stiff
Also my business equipment is permantently mounted in the truck his insurance company is non responsive the adjusters supervisors say use your own insurance we will deal with themshe also said I do not care about what you have to say you are not my customer the insured is . My insurance says you can but you will have to pay the deductable and they will not pay down time for the equipment for the time it is in the shop(about 2 weeks)without it I can not generate income
ok to the questions
Can I recover for the down time of the truck?

Are punitive damages possible?

What are the chances for pain and sufferring?I have witnesses as to me being in pain since the accident

If all I can recover is the damage to the truck and its down time it comes to around 5000.00 dollars should I forget the other stuff and go small claims or hire a lawyer and go for it all?
