My husband was riding his bike to work. He pulls a small trailer. He had this tail lights on, his helmut, flashing lights on his back. The car, driven by an elderly lady, run him off the rode and he messed up his bike(which cost $1000.) and he lost 2 days of work due to injury.

After running him off the rode she came back and told him to get out of the middle of the road or he would get hurt. Then let. My husband called the police and filed a report. The police escorted her back to the scene because the stopped her once and told her to return. She drove off in the opposite direction and they had to stop her again and escort her back.

Can we make the elderly lady the run him off the road, pay for his new bike and lost wages? She actually never hit him, just run him off the road. She ran off the shoulder of the road just before running him off into the ditch. Thanks.

He called and they sent a release for his medical records for the last 10 years. We have not signed it. We are thinking about retaining a lawyer. Any suggestions?

I would not give them any access to his medical records at the moment. How badly was he injured? Will he need further treatment or Dr. visits?

He was riding a motorbike, right? You said it cost $1,000? Just curious. Or did you mean $10,000?

It was a Cannondale bicycle. It cost $1000.00. He was out of work for 2 days and still has problems with his shoulder where he contacted the ground. There are no "emergency room" injuries. She didn't actually hit him, just caused him to fall in the ditch.
