I slipped on a wet spot in a convenience store. The store was
very busy (7:00 am coffee crowd) and I fell hard. The owner helped me up, gave me a bag of ice and an employee escorted me to my car where my husband drove me home. The next day I made an appointment with an orthopedist for the following day because my ankle was extremely swolen and my side and back really hurt. I ended up with a broken ankle and a cracked rib an a prescription for Percocet. I have to wear a walking cast for six weeks and missed 3 days of work. I consulted two attorneys and neither will take my case because they said that just because I fell on a wet floor in a store, does not mean that the owner was negligent. They said that there had to be prior notice of a hazardous condition. What's up with that? I fell because the floor was wet and now I'm being told that I'm unable to recover any damages. Should I keep shopping for an attorney or just deal with the hard knock that life has given me?

My response:

The attorneys you consulted were absolutely correct. Slip, trip, and fall type cases are extremely, and notoriously, difficult or impossible to win due to the "prior notice of defective condition" requirement, and then to prove "negligence" in this type of incident.

Move on.
