Small Claims?


What is the name of your state? Michigan
In December of last year, my son was driving down a local road and another driver pulled out in front of him, through a line of traffic. He was unable to avoid hitting her and severely damaged his car. Repairs are ongoing still at a cost of over three thousand dollars. The other driver was taken into custody that night. She had no insurance (her insurance company revealed that it had been cancelled in October).
I have sent her a letter indicating that I want to settle the costs associated with her negligence (the police report indicates her actions caused the accident) and was seeking to recover the costs to repair this vehicle. She never responded.
I am considering taking the case to small claims court but have been told that only $500 dollars can be recovered, due to No-Fault laws. Is this true?

That doesn't sound right. No-fault usually only refers to bodily injury, not property damage. Sue the deadbeat.

But it never hurts to call a lawyer first
