| | | | Small claims court CA
I was in the accident with another driver, who, I think, was at fault. His insurance blaims me and refuses to compensate for the damages to my car. The insurance company is based in another state, but it has a claim services' firm in CA, which I am dealing with. I am intended to sue the insurance company in the small claims court. Who is a defendant: the actual company in another state or the firm in CA ? I must indicate this correctly on the claim form.
Thank you for your time.

Thank you for your time. | My response:
You don't "sue" the insurance company. The company did nothing to you.
You sue the other driver.

| | | | How is that? He is an isured. I filed the claim to his insurance company, and I dealt with them, not with the driver. They decided, but their decision was wrong...

| | | | Egle, good luck trying to prove to the judge that the ins. co. was responsible for the accident. I will give you some sound advice: try suing the person that was behind the wheel. |

Ken, I know you already read what I had told this writer. But, the writer insists on suing the insurance company. So, let him.
He'll find out soon enough.
