Small claims court


CA
I was in the accident with another driver, who, I think, was at fault. His insurance blaims me and refuses to compensate for the damages to my car. The insurance company is based in another state, but it has a claim services' firm in CA, which I am dealing with. I am intended to sue the insurance company in the small claims court. Who is a defendant: the actual company in another state or the firm in CA ? I must indicate this correctly on the claim form.

My response:

You don't "sue" the insurance company. The company did nothing to you.

You sue the other driver.

How is that? He is an isured. I filed the claim to his insurance company, and I dealt with them, not with the driver. They decided, but their decision was wrong...

Egle, good luck trying to prove to the judge that the ins. co. was responsible for the accident. I will give you some sound advice: try suing the person that was behind the wheel.

Ken, I know you already read what I had told this writer. But, the writer insists on suing the insurance company. So, let him.

He'll find out soon enough.
