What is the name of your state? FL

We loaned our (insured) car to a licensed and insured friend. He had an accident with a woman driving a cleaning company's vehicle. She was issued 2 citations...1 for driving on a suspended license and the other for no proof of insurance. There is actually insurance on the cleaning co's car. If we were to take this to small claims court when the ins co's finally pay off our car, would we need to sue the woman driving or the actual owner of the other car? Thank you in advance.
 


You weren't specific as to who is processing your claim.

If the other company pays the claim then there is no need to file suit.

If your company pays then they will most likely go after the other carrier (or the owner if the claim was denied) for what they paid out plus your deductable. Contact your adjuster.

If you plan to sue any way then make sure you go to the Florida Department of State web site for Florida Corporations and list the name of the company plus the owners and the driver.

Allstate (the other car owner's insurance) is handling our claim, and slower than a herd of turtles I might add.
