I answered your questions correctly. Notice you now acknlowledge that the insurance is now having to pay market value rather than replacement value.

Well, DUH! I think you heard this before somewhere.

Like I told you before, the insurance company may have a responsibility to buy the moon for their policy holder but only responsible to pay for the policy holders liability to you, which is FAIR MARKET VALUE. Nothing more.

They have no liability to you. The only liability they have is to their customer/client. Who would you sue if you were to sue anybody in this deal?; the shop owner.

Just another moron that wants to hear what he wants, not the correct legal answer. We have had a bunch of folks stop by lately with the same problem. I like to tell them to go talk to a local attorney and to print out the forum thread and take it with them. It will make them look like a bigger fool when the attorney tells them the advice they received here was correct.
