Standard Legal Practice Issues


I have a pending bodily injury lawsuit for an auto accident from 1997. In MA does a judgment accrue interest from the date of injury or when the lawsuit is filed and at what rate?
My lawyer required reimbursement from me for all expenses. Initially they were going to be paid by my settlement. He found out my husband had received some monies and asked me to reimburse him. I did. Now he wants me to pay in advance for the expert testimony at trial of my treating physician. He said this will be thousands of dollars. I don't have the money but without the doctor's testimony, according to a judge reviewing the case, the jury's verdict would certainly be significantly lower. Any advice?
Prior to my retaining the attorney, the adjuster had offered me $5000. I did not accept it but having "earned it" on my own is my attorney entitled to that portion of my final settlement or judgment? I put a lot of work into this before the attorney took over. What is common legal practice?

You hired him


so listen to what he tells you.He is entitled to his fee based on your final settlement and yes you pay for expert testimony.No you dont get interest.

YOU SHOULD HAVE PUT THAT IN THE CONTRACT INITIALLY,THAT HE WOULD GET A PERCENTAGE OVER THE 5,000 BECAUSE NOW IF HE GET`S YOU 5,100 HE IS GOING TO GET THE PERCENTAGE RIGHT OFF THE TOP!

I dont believe


any lawyer will want to represent you for a percentage that isnt based on the total award.I could be wrong though.
