Statute of Limitations


What is the name of your state? Texas

I was involved in a car accident 11-14-03 where other driver was at fault. I suffered soft tissue damage that was manageable but really became burdening last year (2005) after having a baby. I was pursuaded to file a claim and managed to do so with a "post mark" date of 11-14-05. The insurance company stated that they "received" it after the 2 year statute of limitations had expired. So, I did not pursuse any further. This came up in a recent conversation with a friend and they told me that if my claim was post marked on that date then my claim should have been accepted. Is that true?

The only thing that matters when it comes to the postmark is your taxes. The law states statute of limitation to file a claim is two years, the law does not state the statute of limitations is two years from a postmark on an envelope. Yes it's nit picking but the insurance company is correct.
