Statute of limitations for non injury accident


What is the name of your state (only U.S. law)?

California


I live in San Diego. While trying to parallel park yesterday, I miscalculated and scraped a car. The driver of the other vehicle wasnt there at the time. I know people saw the accident, but no one stopped. I left my name, address and phone number on the windshield. It is very minimal damage, no dents, just some paint transfer.

Today the note is gone (I'm assuming the driver got it, but we live in an area where there are a lot of college kids that cause mischief, and I know people take things off windshields... for example I got a parking ticket 6 months ago in that very spot. The only way I knew was because my late notice arrived in the mail, even though I never received the first mail notice or the ticket, and I had to pay the late fee). So my first question is, if I put a note on the car and it is removed by a third party, could I still be charged for a hit and run? (I took pictures of the note folded on the windshield, but you cant see what I wrote, so for all they know I folded a piece of paper, took a picture, and then took the paper and drove off).

My second question is: Is there a time limit that they can call me to file a claim on the damage done to the car? The car is not in the best condition, has numerous scrapes, dents, key marks, etc... so its possible that they just dont care about one more scrape on the car. But I'm afraid that they're going to appear out of the woodwork a few months down the line and try to have me and my insurance pay for other damage I didnt cause.

SOL for property damage is 3 years in your state. You should have written down the license plate so you could identify the owner.

I did... got pictures/digital video of her car and my car. What would identifying the owner do?

When you report the accident to your insurance, you give them that information and they can contact the owner to arrange to pay for the damage.
