Stolen Car hit-n-run accident


What is the name of your state? Ca

My car was stolen by someone I know, I did call in a stolen car report after 2 days of it being gone so there is a police log showing that I did call it in. 20 min. after I called it in it was involved in a hit-n-run accident. The police came long story short I didn't file a report. The DA filed charges of driving w/o owners consent. My insurance called it a total loss and since I had full coverage I didn't lose out money wise. The insurance got in contact with the person who stole it and that person admitted to stealing it. But now the insurance wont cover the other car that was hit. .

Are you still with me?? Okay my questions are was it right for my insurance not to cover the other person that got hit? Am i liable for her damages since I didnt file a stolen car report? the DA did though does that count?
Any advice woule be greatly appreciated

Are you saying that your insurance company is not covering the other car involved in the accident? If so, they are not covering it because the accident was caused by the intentional criminal conduct of a person that was not an insured under the policy....You don't want your insurance to cover it and you aren't personnally liable either for the same reasons. Please let me know what I am not understanding.

Yeah my insurance wont cover the damage to the other car that was hit. But then cant the other person sue me? I was dumb and didnt report my car stolen then my car hits another car (2 actually) My car hit 2 other cars theres no stolen car report and no one in my car. If it were the other way around and some car hit me and their insurance doesnt want to cover my damages, plus the car that hit me is supposedly stolen but theres no report I would be thinking of sueing. I hope im wrong and ur right i really dont want to get sued. Plus the other car had insurance so i guess its just their insurance company that wants to get reimbursed. ??? This has almost been a year and it just keeps going and going ...

Of course they can sue...but they are unlikely to win. The only way you could be liable for such an accident is "vicariously" because you were not driving. It's called negligent entrustment...If you allow some to use your car with knowledge that the person is a bad driver, then you are negligent under the law and can be liable for that person's negligent conduct. Its look bad that you didn't report the call stolen right away but if there is a reasonable explanation, then you'll be fine. I just got a case out on summary judgment where a brother stole his sister's car and got into a wreck. The sister was not aware that the car was stolen until after the wreck, so no time to call the police and report it stolen.
