Stolen and Wrecked involving Fatalities


I live the Orlando, Fl area. Recently my new automobile was stolen and within hours involved in a fatal accident. The police have fully investigated the incident and all required accident reports have been filed. My auto was classified as being totaled.

My Insurance Company does not want to repair/replace my car, they only want to compensate me for what they say is the value of the automobile. My insurance company is now telling me I'm responible for the remaining balance.

Had I or someone I authorized to drive my vehicle been driving at the time of the accident, I could understand the repercussions. Do I have the right to deny the Insurance Company's offer and request them to repair or replace my car? Do I have any other options available to me?

Your insurance company's obligation to you is the same no matter how the car is damaged. You are owed the depreciated value of the car, minus your deductible, and no more. If you were upside down on your loan and did not have gap coverage, that's on you.

Why would the insurance company be responsible for the amount owed on the vehicle before they even came into the picture?

YOU were always responsible. Plan on paying the money.
