| i live in southern california and last july my husband was in a accident that the insurance companies deemed his fault by 100%. our insurance company settled claims with 2 out of the 3 people. now almost a year later the insuance company finally got a hold of the 3rd person who procrastinated in filling a claim. this person wants more money from the insurance company now that the insurance company can and will give. This 3rd person is now taking my husband to small claims court to get the damages she wants. the insurance company will give her half, but if we lose we will be responsible for the balance (according to our insurance company). the balance of these costs are mainly car rental fees that she had following the accident before she filled her claim. how should i prepare to go to small claims for this when i feel the insurance companies were reasonable and she waived her right for rental car coverages when she purchased her insurance? please advise |
