They fixed the wrong part!

What is the name of your state? NY

Sorry if I posted this in the wrong place.

I recently was backed into. Had an estamite completed to repair my rear bumper. My mother picked my car up for me and when she dropped it off to me I noticed the bumper wasn't repaired. Took the car back in today. The employee stated they fixed the front bumper! So they told me that they would fix the rear bumper free of charge, lol. That was obvious. I requested a loaner car...no can do. I requested they pay for a loaner car for me...they won't! What should I do? They said they would fix it whenever it is "convient" for me...no time is convient to not have a car especially since if they fixed the right thing the first time I wouldn't be going through this. Thank you in advance for you help.

If you were backed into, was the other driver found at fault & their ins. co. is paying for the damage repair to your car? If so, did you check to see if the other driver's ins. co. might pay for a rental car while yours is being fixed?

You know how sneaky those insurance companies can be though. The front damage is already repaired. How would you sneak this past the insurance company?

Did you pay them for the repair of the front bumper? If so, why?

If the work order clearly stated rear bumper, I would not have paid them to begin with. You might try telling them you want the money back. (although unjust enrichment comes to mind). Unless you have a requirement to use this shop, I would try to get my money back and take the car elsewhere for repair.

I'm sorry I should have explained in more detail. The person who backed into me paid for the repair out of his pocket. No insurance claims were made. I (or my mother to be exact) paid the collision shop for what we thought was the rear bumper. On my estimate and reciept it states rear bumper. The shop knows they made a mistake. Unfortunately my mom didn't know what the damage to the back bumper looked like to begin with so she wasn't sure what to look for. My main question is...should they have to pay for a loaner car since they will need my car for another 2 days?

from what you post, I am presuming the person that backed into you did in fact damage your rear bumper. I also gather you already had some damage to the front from some other incident.

You see, you never told us what bumper the other guy damaged.

Did the injuring party pay for a rental for you during the first repair? If not, tell them to pay for it now.

What did you do for a car while yours was being repaired the first time?

The person who backed into me damaged my rear bumper which caused a scratch and dent. There were a few scratches in the front bumper, but no dents (nothing I would have gotten fixed). Yes, a loaner car was paid for by the injuring party.

I agree that morally, the shop SHOULD give you a loaner or pay for a rental. Many years ago, I went to pick up my car after being repaired after an accident, drove it off the lot and about 3 blocks later, it started overheating...oops. And in my case the shop DID pay for the extra 2 days of the rental car that I needed. I'm not sure if they are legally REQUIRED to provide you with a loaner/rental though.
