What is the name of your state? Florida

Was rear ended last Nov.04 by a pickup truck doing 45mph. Minor damage to both vehicles. Experienced sharp pain in neck on impact, but pain slowly diminished. Short story, did not contact either insurance co., however, I do have copy of FHP accident report showing other driver at fault. Approx 3 weeks ago started having pain in my shoulder, neck, and arm. Decided to go to my chiropractor. After comparison of old and new xrays, he says I have visible damage that is compatible with being forcefully struck from behind. Question: Have I waited too long to pursue a pip claim. It is now, of course, March 05. I didnot go to a doctor at the time nor report it to my insurance co. What can I do?

limitation


do not hold me to it but i have done research on this subject because i am in a predicament just lik it. there is a limitation of 45 days to inform and settle a case of injury or payment i am afraid that you have to inform your health insurance or take the other drivers insurance to court

Were you both driving tanks? you don't have minor damage from a 45 mph impact. so which is it - low speed rearend impact or 45 mph impact?

damages


Damages to vehicles was minor...of course, he knocked the crap out of my Reese hitch before the bumper was impacted..FHP said $200..

I get hit in the rear as well. I was driving a clubwagon (tank), and she was in a mid size sports car. she hit my trailor hitch. her car never touched my bumper but bent the hitch up, buckled the hitch under the van ( the part attached to the van) and the hitch bent the bumper up. the hitch went through the front of her car, into the engine compartment. 1100.00 in damage, and im STILL hurting from it (4 months later).
and she told the police she was doing 5 miles per hour. I was stopped.

Florida..I still do not know if I should persue the pip at this late date or if I should just file on my health insurance
