thrid party insurance

This happened in New Zealand:

- I had a car accident on Wednesday. I can't use my car anymore. It was not my fault and I have a third party insurance policy.
- The other person involved in this accident, said it was not his fault.
- He didn't want to wait for the police but gave me his registration number and cell phone number.
- I went to Auckland Central Police Station. The police officer told me that it had not been my fault.
- We didn't fill out any forms. Nothing was recorded. I was told to call my insurance company.
- My insurance company told me to talk to his insurance company.
- His insurance company said, they couldn't do anything before he doesn't make a claim.

Who has to take action now? Can I have repairs done on the car now and try to get the money back later? Can I get a rental car?

Thanks in advance for your help!

Bring all the vehicles to the U.S. and re-do the accident and we can try to help.
Otherwise, as shown at the top of the screen.....
"U.S. LAW ONLY "

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Do you think it would make that much of a difference under US law?

OK, I see:

before he makes a claim?

you're going after his insurance, he doesn't need to make a claim.

what he does need to do is get in contract with his insurance and make a statement about what happened.

he may lie, say it was your fault, and his insurance will deny your claim. in that case you need to go to small claims with all the reports/evidence you have.

you may have a problem proving its his fault though without a report/witnesses.

And why the hell did you go to the "Auckland Central Police Station" since this accident happened in 'Idaho'???

I am going to try to be very nice (since I have a fair amount of relatives in KiwiLand)..... the laws are completely different there than here. Heck, you guys even drive on the wrong side of the road!! And to make it worse, you don't even have highways... you have 'motorways'!!

Seriously, as in any legal issue, the accuracy of any response that you get will be directly related to the FACTS that you present. If you make up the FACTS, the response you get will be worthless.... and a waste of everyones time.... including yours.
