Michigan.
My son was involved in an accident on 7/16 in Fraser, MI. He dozed off and rear-ended another car. No injuries. No DWI. Breathalizer given and passed. No ticket was issued at that time.
Yesterday, we received an envelope postmarked 7/18 with a ticket inside. Nothing else was in the envelope. Ticket is for "fail to stop assured clear distance ahead."
Two questions:
1. Is it legal to send a ticket through the mail after the fact?
2. The officer checked the box on the ticket that says that he served a "copy of the ticket upon the defendant (or owner/occupant by posting if applicable.) Obviously, their is no signature by my son, as the ticket was issued after the accident. At the time of the accident, the officer gave no indication that he was issuing a civil infraction.
Is this ticket legal?
