tire blowout


NJ-

After making a right turn I heard a loud popping sound and felt my car pull to the right, so I slowly pulled over the right lane since there was no shoulder. I immediately put on the hazard lights and checked the tire. As I suspected, my front right tire had just blownout, so I called my father to see where the nut lock was so I could call for help to change the tire. After I searched the glove compartment and the trunk, a cop pulled up behind me and asked what happened. This was about 10 minutes after the blowout. I said I didn't know exactly what happened, but I had just had a tire blowout. He took a glance at the tire, walked to the curb, and said, "I'll tell you what happened. You hit the curb. How could you not realize you ran up the curb? It could have been a person! This is no longer just a blowout. This is an accident. I'm giving you a ticket." So he gives me a ticket for careless driving and checked off a box for property damage.

I am 18 years old and have had my provisional license for exactly year. I was about to get my real license this weekend. I have had no previous encounters with cops, and receive a "good student" discount from my insurance company. I did not feel the car jump the curb. I had a witness who was in the car with me.

Although I understand it's an 85 dollar ticket and 2 points, my court date is in June and I want to know my chances of getting my ticket waived. Did I really deserve this ticket?

Have your attorney plead not guilty for you.
