What is the name of your state? Alabama

i was going to town one night in my truck and the tire came off
my truck and hit another car the state trooper told me since
my truck did not make contact with the car that I was not
responsable now the insurance co from the other car wants me to pay 3500.00 because they totaled the car. what is my legal responsabilty?

The officer did not mention failure to maintain load? Your truck and it's trunk? Anyway, the tire (yours) caused damage to another's property...

Please answer as to what your insurance carrier stated.

the damn tire did not come out of the back of the truck it came off of the damn axle.

*** Let me make this very simple for you. YOU are liable for the damage that your wheel caused to the other party. If the wheel came off due to some mechanical failure or negligence by another (mechanic failed to tighten, etc.), then you might consider taking action against that other party. In the meantime, you are responsible for maintaining YOUR vehicle and that includes making sure that it is safe and the wheels don't fall off.

Turn the claim in to YOUR insurance company.
