total loss

What is the name of your state?What is the name of your state? Colorado. I was in auto accident and the the at fault driver doen't have insurance. My insurance company claims it a total loss. They came up with a fair value of my vehicle. I would like to keep the totaled auto. My suggestion is to take fair value minus salvage value and keep the balance, plus let me keep my car. My insurance company say it is against company policy. My policy doesn't state this. And said that it is not in writing it is an unwritten rule. To much liabilty. I would accept a salvage title for the auto. My question is there any laws or regulations backing the insurance company and can they prevent this from happening. I am not going to repair the car I want to part it out. Thanks in advance for any help in this matter. Jim
