totaled car included in bankruptcy. TX

i was involved in a car accident on june 1,2001 a lady rearended me (and my 2 children)knocking us into oncoming traffic where another vehicle struck us. the ins. adj. says i can only get the fair market value minus deductions for high miles etc. the car was included in our bankruptcy from 2 years ago and the car should have been paid for 1 year ago but, the bankruptcy trustee can pay what they want to. so can i keep the money that i get for the car from ins.? or, do i have to send it to our trustee? if i do then i will have no money for another car and noone will finance someone a car who has filed chapter 13! it has been 45 days now that i have not had a car. no one was seriously injured but we do have high med. bills. ins.adj. will not return my calls. thanks for any advice.
