What is the name of your state? Arkansas
My wife was involved in an accident in which she was hit from behind, and was not at fault. My question is this: It the repair cost to the damaged vehicle is 70% or more of the value of the vehicle (1998 Chevy Cavalier) does the insurance company that is handling the claim have to declare the vehicle totalled? Is there a law that requires this? The insurance adjustor has stated that the law does not apply if the vehicle is over 5 years old. I am getting conflicting information on this. Does anyone know?
