Tree Fell on Car


What is the name of your state? KY

A tree owned by an apartment real estate company fell on my car and caused a lot of damage. I've already filed a claim with my insurance company. Would the Real Eastate agency be liable at all? I have a $500 deductable and I don't think I should have to pay.

If the tree was diseased, dead/dying, or decayed AND the owner knew, or should have known, of that fact, then they could be held liable (negligence for not removing a hazard). Howeve, if the tree simply fell or broke due to "Act of God", then they would not be liable.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Young people with no money have no choice but to do what they can do. i.e pay less per month and have a higher deductable. I appreciate your help. But your attitude is not only unfunny on so many levels but insulting as well.

Jess, what has happened with the apt. complex' insurer? I would sue the apt. complex in hopes they settle just to avoid the nuisance....they know how much it will cost to appear in small claims court...

BTW, I too have noticed that many of the very senior members on here with several thousand posts sometime make very sarcastic and unhelpful comments...it would be nice if they got off their high horse and actually tried to HELP people instead of joke amongst themselves about how much they know compared to others...dont be discouraged...

Its a damn shame people come to these forums looking for HELP, but more often than not they are met with sarcastic and unhelpful replies from a few people who have spend the majority of their time on this forum NOT providing helpful information, but rather trying to be part of some pseudo elite internet club...


belittling others only shows your ignorance ...too bad this forum does not have better contributors, it could be very valuable

i cant believe how many dozens of posts ive read where these SAME few users who have posted THOUSANDS and thousands of times are doing nothing but berating and belittling others....

to their credit, they do occassionally offer sound advice, but the VAST majority of their thousands and thousands of posts are just to boost their fragile ego and post count....

I encourage any of you "senior members" to visit fatwallet.com their finance forum often has legal discussions and they are KIND, RESPECTFUL AND MATURE....unlike you losers....
