underinsured uninsured car insurance

new york. if someone is involved in an automobile accident and it is the other drivers fault .and a lawsuit is taken out for injuries against the other drivers insurance, but the other drivers insurance is minimum,can the party who is injured collect for pain and suffering from his own insurance company under underinsured uninsured. or will that kick in for medical payments only.

You really have to look at your policy documents to know for sure.
