Undetermined Fault Accident

What is the name of your state? NM
My fiance was in a car accident last month. It took the police six weeks to complete the case report. basically it states that the fault is undetermined due to lack of witness. She had to pend a week in ICU and a week in rehab hospital as an inpatient. How do we go about filling a claim for medical expenses when the fault is undetermined.

The damaged person sues the person whom the damaged person believes caused the damage.

The court will then decide who is at fault.

(There is such a thing as accident reconstruction which can be very accurate. If you think the other party is at fault, hire an accident reconstruction expert.)

Describe what happened in the accident. What did his insurance determine about fault? The other driver's insurance?
