Unfair settlement

What is the name of your state? NY
Daughter on single lane road, left blinker on for turn into private driveway. Driver behind her in company van passes on left as she turns. Police rpt states unsafe passing/lane change by van driver - but no ticket issued. He didn't have license or registration or insurnace info on him. Van driver claims daughter had right blinker on - No driveways on right to turn into. She contacts his ins. co. They offer her only 50% of their adjusters estimate. She doesn't want to file w/ her ins. in fear of rate increase. She refused settlement. Is this just an insurance ploy?

This is what insurance companies do to try and save money. Your best bet may be to turn it into your insurance company and let them deal with it.
