Uninsured Motorist, but accident was not my Fault


What is the name of your state? IN

I was in an accident today, but the accident was not my fault. My car had the most damage, it had to be towed away and the other driver was abel to drive their car with little damage. I need to know if the driver is responsible for the damage to my vehicle and also if their insurance company is responsible for providing a rental car until my vehicle is repaired. Please advise!

My response:

Why aren't you waiting until Monday to ask their insurance adjuster? All we have is your statement that "the accident was not my fault", but that's your opinion. For all we know, there may be some "comparative negligence" on your part. We don't know what his insurance adjuster will do until there is an investigation of the accident, and then they'll make their own conclusion.

In the meantime, use your own insurance company and if the accident is truly found not to be your fault, then you'll get your deductible reimbursed.

I'm sorry, but I do not have any insurance. I have been unemployed for the previous 3-months, and my insurance has lapsed. There is no doubt; the accident was not my fault. I was driving eastbound and the driver was originally going west bound, then turned into my vehicle to potentially enter a McDonalds. I had the right-away and was not speeding.

Oh, so it was YOU who was driving illegally. Sorry, I don't assist anyone who violates the law.

PLEASE HELP ME! I ADMITT, I WAS WRONG FOR DRIVING WITHOUT INSURANCE, BUT AS I STATED PREVIOUSLY, I WAS UNEMPLOYEED. NOT TO MENTION, I'M A SINGLE PARENT WITH TWO KIDS IN COLLEGE. I HAD OTHER PRIMARY BILLS TO WORRY ABOUT! PLEASE HELP!
