uninsured motorist not at fault

What is the name of your state? Illinois
i was involved in an auto accident at about 3:30am in chicago. I was waiting in the second lane closest to the left side to merge into the left lane and get onto the express way. i saw a car in my rear view mirror and since it was so late and there was no one elso on the road i waited for him to go past. i really don't know how it is he came into my lane but he did and hit my fender, cracked my bumper and messed up my suspension. i also believe he was a little under the influence. it took the cops about 45 minutes to arrive to the accident and by then he had moved his car to the side of the road. the cops did not issue any tickets but when they pulled up my insurance it came up suspended. i did get a ticket for that. i went to court and had that dropped but the insurance company is saying i was not insured. his insurance company is now trying to collect $8,000(?) in damages but has not provided me with any information just a lot of threats. Please help. I am also married to military if that makes any difference.

Yes that makes a difference. It means if the insurance company files suit against you and wins they can attach the miltary paycheck, they see an EASY way to get get reimbursed for their loss.

You will have to hire a lawyer to prevent this from happening.
