Uninsured Rights??!!!!!


WHAT STATE: NV


My Brother Got Into A Car Accident And My Car Was Totaled. It Wasnt His Fault...but My Car Wasnt Insured At The Time. The Ladies Insurance Company Has Claimed My Vehicle A Total Loss And Is Now Offering To Pay For The Remaining Balance Owed On The Vehicle To The Dealership...and They Keep The Car..or The Other Option Is For Them To Pay For The Vehicle And I Keep The Car But I Would Have To Pay To Get It Fixed Myself.... Is That Right?? Can They Do That? Because Either Way Im Screwed Right??!!

It Just Doesn't Seem Right... Either I'm Left With A Totaled Car That I Have To Pay For Repairs On An Accident That I Didnt Cause Or Have Them Pay The Remaining Balance And Be Left With No Car...shouldnt They Be Responsible For Something???????

Maybe next time you drive a car or allow someone else to drive your car, you'll obey the law and have insurance coverage that could help you out in a situation like this. You were breaking the law by having your car on the road without insurance on it so you're lucky that they'll pay your loan off for you. What did you think you'd have coming to you? A new car? You should be grateful the other driver had insurance or else you'd be even more screwed than you already are.

At most, you would be entitled to the fair market value of your vehicle. If that is less than what you owe on the car, consider yourself lucky.

Are they offering at least fair market value??

Does the OP realize that both him and his brother could also be looking at having their driving priveliges suspended? One of the joys of owning and driving uninsured. Also, quit with the capalization of every word.

Then the OP wouldn't need to worry about getting a new car.

Thanx anyways...but everything worked out for the better... They paid off my car..and for the rental and i was also able to get a new car!!!! I have researched on alot about this and got alot of answers i didnt get from here...see i didnt give up!! its a good thing i didnt let what some of you say lead me to giving up. Finding all i can about my rights and nevada laws really helps!!!!!!!! thanx again!!!

Hopefully, you have realized that the most important lesson to be learned from thins ordeal is to stop driving without insurance.

I don't understand what information you are saying that you got here, that wasn't helpful. The LAW states that the ONLY thing they are REQUIRED to give you is fair market value, or actual cash value. Of course, they will pay for a rental. That's just common sense. If you received anything about the fair market value, OR if you owed less on the vehicle than it was worth, then that was just an added "bonus". So, what did someone else tell you, that noone here told you?
