uninsured woman hit my parked car


On October 13th a woman who wasn't insured backed into my car
with the intent of hitting her boyfriend who was a pedestrian. She sideswiped my boyfriend's car and backed straight into my car moving it back two carlengths. She then took off and left the scene before we even had time to exit our house and see what had happened. Though she showed an insurance card, we came to find out that she wasn't insured, and though we thought we had uninsured motorist protection in our policy, we soon found that we didn't. Question. Aren't we supposed to sign a waiver saying that we don't want uninsured motorist on our policy? And is there any thing we can do to recover the money for the damage from this woman? Our collision is paying for it now, but I we (my boyfriend and I) have to pay a 500 dollar deductable on both cars.

You are correct in that you need to sign a rejection form when declining to carry UM.

Unfortunately, it plays no role in this claim since UM is for injuries and not for damages to your car. That's what your collision coverage is used for.

After your carrier pays your claim it will "subrogate" against the other driver. Meaning that they will attempt to recover from her what they paid out. They may also recover your deductable.

You may chose to sue her separately for your deductable.
