Unisured driver that rented from Avis hit me


What is the name of your state?
New Jersey

I was hit from the back in my 2000 mustang conv that I just finished paying for this year and dropped my collision and took liability only. The driver rammed me from the back when I was almost at a complete stop in traffic forcing me under a suv causing my front and back of the car to be crushed. I was unable to open my door and climbed out. My airbag didn't deploy, and my fiance came to the scene and took pictures of the car. i went to the hospital and suffered headaches and whiplash. The driver reported to the officer he was at fault, but the ins info he gave was false. He had a rental car from Avis. I did a follow up visit to my Dr, and she gave me prescriptions to get a cat scan/xray. My car is garbage and I had to take days off work. I don't have another car or the $ to pay for a rental? Avis just realized they are liable. I want to settle to get the $ my car is worth so I can be done with this situation and get a car so I can get to work. I have been using my fiances and she has been taking car service to work. Avis and the ins companies have been a nightmare. I still get headaches and feel more of a pinched nerve. I don't think my personal damages are worth suing, I'm glad I am alive and ok, but do still experience pain. . Please help, I don't know who should be responsible for what. I appreciate the advice

First of all on a car that is not that old you should always keep your collision coverage.

If Avis has excepted liability then they would be responsible f/ fixing the damage to your car or giving you fair market value if it is deemed to be totalled. They will also be responsible f/ a rental car as well as your medical bills and any punitive damages that would be paid. I don't know if your state is no-fault or not. Where I live everyone turns their meds into their own carrier initially. You need to find out what the state law in Jersey is regarding payment of medical bills. Avis may have to pay them as they accrue or they will wait until they settle w/ you before they pay.
At least they accepted liability.
