Unleashed dog causes teen to damage car


What is the name of your state (only U.S. law)? Georgia


My roommate was getting ready to walk her dogs yesterday evening and she had one on a leash and one wasn’t on a leash. Two teenagers walked by and the unleashed dog ran after them. One teenager was so afraid that he jumped on my car. My roommate yelled at him and told him to get off the car and that the dog would not bite him. Every time the kid tried to get off the car, the dog would yap at him again. So he kept jumping on my car. She wouldn’t tie up her dog to let the kid go.
While driving to work this morning in the car and I hear a very funny sound and I looked at the windshield and there is an 18 inch crack in it. The crack was not there on Tuesday when I drove the car last. The cost to replace the entire windshield is over $400. My question is: Do you think my roommate is liable for the damage? Or must I pay. I’ve heard that it is against the law to have unleashed dogs in Georgia.

If you must self pay,

I would strongly urge you to get a second estimate

400 seems a bit high

Sue the teenager AND the roommate in small claims for your actual damages (agree with $400 being high).

Please explain how a crack in a windshield can cause a funny sound.

I'm not an auto expert, I don't know why there is a sound. But there is a distinct rattling when traveling at speeds greater than 50mph. It's a sound I have never heard before. I assume it is because the glass is weak.

I think the teenager who jumped on your car is liable.

My windshield was going to cost me $350 to replace (which is why I haven't replaced it yet) and that was with a discount from my insurance. It has a "rain sensor". So it's not necessarily high at all.

I've had the windshield replaced on a Chevy Suburban for under $200. Mine was an older model without all those new-fangled gadgets though...
