unlicensed driver in accident-


What is the name of your state? Illinois

Complicated.

My 15 year old daughter was in a car accident in 1999. She was with her 24 year old dancing teacher who decided that she would teach my daughter to drive. She did not have my permission. In fact I did not know my daughter was the driver until recently- 4 years after the fact. She did not have a learning permit---she wasn't scheduled to have drivers ed until the following year.

There is a lawsuit in action against the car owners insurance. It has been held up for years- mainly due to ongoing treatment & to the lack of co-operation of the car owner.

After the accident- while my daughter was unconscience- the driver moved my daughter over into the passenger seat. All the reports have the car owner as the driver. All insurance has the car owner as the driver. My daughter had no memory of the day & says that until a year or so ago--she didn't remember. When my daughter confronted the car owner about it- being confused about it all--- the owner said that "That never happened" so my daughter has been confused by these memories.

My daughter injuries were complicated with rehabilitation, seizures & other issues. There are many thousands of $$ in medical bills that have come out of my pocket. As for her regular health insurance- she is basically un-insurable. So she has a life time of outragious medical costs to look forward to. She is epileptic & almost disabled from this.

What does this do to our case? Does the car owners insurance still have to pay? What happens to the car owner who falsified police & insurance reports? What can be done to the car owner for taking my daughter & telling her that she would teach her to drive & sent her down one of the most dangerous tiwsting roads in our state? with out parental consent.

The car owner has not decided what she is going to do. claim that she was driving or to all the sudden change her story.

The car owner has accepted payment for the car, & had her medical bills paid.

Can I now be responsible for the entire deal? what consequences may my daughter have to face?

I can't go ask her lawyer. Tell me how to approach this all,

It is HER lawyer. She is 20 years old now.
