Unsafe passing on right


Help!! my 64 chevy pick up was hit on the right side by a driver who did not see my blinker as I was makeng a wide right turn into a private drive. the police report stated that the other driver was 100% at fault in violation of CA. vehicle code 21755 ~ passing on the right when unsafe. As I did not have collision. my insurance co says that they can not help. My problem is that his insurance co says that they are claiming 60/40
and are willing to cover only 60% of damages!!! A private estimator put cost of repair at $4000.00/
exceeds value of truck. I want 100%!!! Please
help!!
PS> my neighbor, a officer, says that the report shows that other driver was cited ( not on site, but latter ??

Since you had insufficient insurance, and we can't represent you by calling the adjuster to negotiate, and since there's not enough money in your situation to interest an attorney, then just how can we help you?

The help that I would like is any info on how to get his insurance to give my the 100% that I am intitled to. They owe it to me and I deserve it!!
