My wife was in an automobile accident with significant injuries to her arm. Surgery was required, but she is going to recover. We did not want to sue the lady because she did not have anything. She had the minimum coverage, 10-20-10. We were told to bill everything to our health insurance and settle for the $10,000. We also have $25,000 from our insurance for pain and suffering and $2000 for Medical payments. I recieved a letter from my health insurance stating that if we have reached a monetary settlement they are going to assert a subrogation and or reimbursement interest on any settlement proceeds. I was told that if we settled with the insurance company and no other funds were available the health insurance had to take my claims as primary. Can they try and recover the money that I have settled for. |
